In his presentation, Mr. Fox focused on the rights and remedies available to a tenant or landlord under a residential or commercial real estate lease when either party files for bankruptcy protection. His presentation covered various bankruptcy issues, including the automatic stay, and the treatment of the landlord's claims following the assumption or rejection of a residential or a commercial real estate lease in Bankruptcy. He explained how the Bankruptcy Code classifies and treats the respective claims of both a landlord and tenant, as well as the various procedural steps necessary for the protection of such claims. He offered strategies for both landlords and tenants when required to appear in the bankruptcy court. Additionally, Mr. Fox provided the audience with valuable information related to strategies for both landlords and tenants when drafting commercial leases.
Mr. Fox, a Voorhees resident, has developed his practice in the areas of commercial litigation, commercial transactions, bankruptcy, business law, real estate, zoning and land use law. His real estate experience covers a wide variety of industries, including real estate developers, shopping centers, manufacturing, office, solar energy and rail roads. He leads the firm's Renewable Energy Law practice. Recently, he successfully assisted clients with obtaining applicable use variances, bulk variances and preliminary/final site plan approval for the development of a 10 mega-watts photovoltaic solar powered electric production facility to be located in Upper Deerfield Township, Oldmans Township and Carney's Point, New Jersey.
He is a member of the New Jersey, Pennsylvania, and Camden County Bar Associations and is admitted to practice in New Jersey and Pennsylvania. Mr. Fox received his law degree from California Western School of Law and his B.A. degree in Economics from Rutgers College.
