Mt. Laurel, NJ – – On behalf of Norfolk Southern Railway Company, Capehart Scatchard Shareholder, Alan Fox, Esq. recently argued before the New Jersey Supreme Court involving a case of first impression concerning interpretation of the recent amendments to the New Jersey railroad condemnation statutes.
Mr. Fox was successful in obtaining approval from the Commissioner of New Jersey Department of Transportation of Norfolk’s petition for condemnation of land adjacent to Norfolk’s Croxton Yard intermodal facility located in Secaucus, New Jersey. The approval was affirmed by the Appellate Division. A decision in the case is expected by the end of the year.
Mr. Fox, a Voorhees resident, has developed his practice in the areas of commercial litigation, commercial transactions, renewable energy, bankruptcy, business law, real estate, zoning and land use law. Mr. Fox is currently assisting the City of Camden in connection with condemnation of abandoned properties.
